Federal law currently treats Delta 8 as hemp as long as the source material stays under 0.3% Delta 9 THC by dry weight, which is where the 2018 Farm Bill draws its line. States write their own rules on top of that, and those rules move constantly. Restricted states are blocked at our checkout, but look up where you live before you order.
The statute is Section 781 of Public Law 119-37, enacted a year earlier with a twelve-month runway. Two things shift when it lands. Hemp stops being judged on Delta 9 alone and starts being measured as total THC, which sweeps Delta 8 into the calculation. And any finished hemp cannabinoid product is limited to 0.4 mg of total THC across the entire container, a fraction of what anything on this page holds. The Senate has passed language moving most of Section 781 to December 11, 2026, but the House has not agreed, and the President has not signed, so the original date stands as we write this. We are watching the rulemaking week to week and will revise this page accordingly. None of this is legal advice.
