How Georgia Regulates Hemp Today

For several years, many THCA flower products were marketed as federally compliant because they contained less than 0.3% Delta-9 THC by dry weight, even though their THCA content was high. Georgia closed that gap with Senate Bill 494, which Governor Brian Kemp signed on April 30, 2024, and which took effect on October 1, 2024.

Under SB 494, Georgia no longer relies on a Delta-9-only standard. Instead, the state uses a total THC approach that accounts for the Delta-9 THC a product can produce when THCA is heated (decarboxylated). In practice, the calculation works out to roughly:

(THCA × 0.877) + Delta-9 THC must be 0.3% or less by dry weight.

Because typical THCA flower contains anywhere from about 15% to 25% THCA, most THCA flower exceeds this total-THC limit and is classified as marijuana under Georgia law rather than legal hemp. SB 494 also introduced an age requirement of 21 and older for all consumable hemp purchases, mandatory full-panel Certificates of Analysis from licensed labs, and licensing and labeling requirements administered by the Georgia Department of Agriculture (GDA).

A Note on Raw Hemp Flower

Separately from the total-THC test, SB 494 includes language restricting the retail sale of raw cannabis flower and leaves. There is ongoing legal debate over exactly how far that restriction reaches, for example, whether certain processed or infused flower products fall under it, and the issue has been the subject of differing interpretations and potential litigation. What is clear is that high-THCA raw flower of the kind traditionally marketed as "THCA flower" sits squarely in the restricted, high-risk category. We recommend treating raw THCA flower as non-compliant for Georgia and reviewing the current GDA guidance before making any purchasing decision.

Federal Direction

Federal policy also appears to be moving toward a stricter total-THC standard that would more closely match Georgia's approach. In November 2025, the federal government enacted Pub. L. No. 119-37, which amends federal hemp law to incorporate THCA into the total THC calculation, with a phased effective date in 2026. Details and timing have been described inconsistently across sources. Regardless of where federal law lands, Georgia state law already governs what can be sold and possessed within its borders, and SB 494 has been in effect since October 1, 2024.
