Tennessee’s hemp laws have changed under House Bill 1376, with the key provisions taking full effect July 1, 2026. The new law bans the sale of THCa and other intoxicating hemp-derived cannabinoid products, shifts regulatory oversight from the Tennessee Department of Agriculture to the Tennessee Alcoholic Beverage Commission (TABC), and limits any permitted hemp sales to licensed establishments restricted to customers 21 and older.

THCa flower was historically treated as hemp when derived from compliant hemp containing less than 0.3% Delta-9 THC. That changed with two developments:
- State law: Tennessee’s HB 1376 bans the sale of THCa products beginning July 1, 2026, using a “total THC” standard that captures THCa (a precursor that converts to Delta-9 THC when heated).
- Federal law: In November 2025, Congress redefined “hemp” at the federal level to be based on total THC (including THCa) rather than Delta-9 THC alone, with the change taking effect on November 12, 2026. This is widely expected to render most THCa flower products federally non-compliant.
