Colorado THC Drinks

Buying hemp-derived beverages in Colorado comes with state-specific considerations. ATLRx ships hemp products to customers in states where our offerings meet local regulations, and every product is third-party lab tested with a Certificate of Analysis available on request.

Importantly, federal Farm Bill compliance does not automatically equal Colorado compliance. Colorado enforces its own per-serving THC limits and CBD-to-THC ratio requirements for hemp products sold in the state. Before placing an order, customers should confirm that the specific product they're considering meets Colorado's current requirements.

Colorado Hemp Beverage Rules at a Glance

In Colorado, hemp products are regulated by SB 23-271 and 6 CCR 1010-24. The hemp product rules are administered by the Colorado Department of Public Health and Environment (CDPHE), with intoxicating cannabinoid oversight handled by the Colorado Department of Revenue's Marijuana Enforcement Division (MED).

The key rules for hemp beverages sold to Colorado consumers are:

  • A general cap of 1.75 mg of THC per serving with a minimum CBD-to-THC ratio of 15 to 1 (stricter 1.25 mg per serving and 20-to-1 ratio thresholds apply for products that can be sold to consumers under 21)
  • A prohibition on chemically modified, converted, or synthetically derived intoxicating cannabinoids, including delta-8, delta-10, and HHC produced from CBD.
  • Packaging, labeling, and testing requirements set by CDPHE
  • This is a meaningfully different framework than states like Minnesota, Tennessee, or Texas, where higher-dose hemp THC beverages (5–10 mg per serving) are commonly sold. Many popular hemp seltzers nationally are dosed above Colorado's per-serving cap and do not meet the 15:1 ratio, which means they are not eligible for sale to Colorado consumers.

THC Drinks in Colorado – Frequently Asked Questions

Hemp-derived beverages can be sold to Colorado consumers only if they meet Colorado’s hemp product regulations, which currently cap THC at 1.75 mg per serving and require a CBD-to-THC ratio of at least 15 to 1. Higher-dose hemp THC beverages common in other states (5–10 mg per serving) do not currently meet Colorado’s requirements for sale within the state. Federal Farm Bill compliance is not sufficient on its own. Under Colorado law (SB 23-271 and 6 CCR 1010-24), hemp products sold in Colorado must generally contain no more than 1.75 mg of THC per serving and maintain a CBD-to-THC ratio of at least 15 to 1. It is illegal in Colorado to sell chemically modified, converted, or synthetically derived intoxicating cannabinoids such as delta-8, delta-10, and HHC. Customers should also be aware that federal funding legislation (H.R. 5371 / P.L. 119-37) signed on November 12, 2025, redefined hemp by total THC content and imposed a 0.4 mg total THC per-container cap on finished hemp products. The new federal definition takes effect on November 12, 2026, and most intoxicating hemp products are scheduled to phase out of legality at the federal level on that date unless Congress passes corrective legislation. The law is constantly changing — always verify the current state and federal laws before purchasing.

ATLRx works with retailers in states where our products meet local regulations. Because Colorado has specific hemp product requirements — including the 1.75 mg THC per serving cap, the 15:1 CBD-to-THC ratio, and the prohibition on chemically modified cannabinoids — wholesale availability in Colorado is limited to products that meet those standards. You can contact our team to discuss which products in our catalog are eligible for the Colorado market and what documentation we can provide for compliance purposes.
