South Carolina often gets left in the dust by its sibling, North Carolina. Guys, what about South Carolina? I hear great things, but my familiarity with South Carolina is vague; I've only driven through it no less than 100 times as an east coast vagrant. It's still blowing my mind that Delta-8 THC and other cannabinoids are sold legally in the south. What is the legality of Delta-8 THC and all of the rare cannabinoids within the industry in South Carolina? Any cannabinoid has to be hemp-derived with delta-9 THC level of 0.3%.
South Carolina has been one of the more defying states when it comes to Delta-8 THC. However, they don't have medical or recreational marijuana; but low THC oils are legal exclusively for those who have epilepsy. This law was under Article 18, Section 44-53-1810, better known as "Julian's Law." The decriminalization of marijuana hasn't happened yet. You can still face a misdemeanor if you have less than an ounce, but that's only your first time. You could still be facing six months in prison, which is absurd. Surprisingly, Georgia's possession laws are looser. You're more than likely to get a citation; then, you can skip and click your heels. It's still a schedule I drug in the State of South Carolina. Thankfully for South Carolina, Delta-8 is a different story.
"'Hemp' or 'industrial hemp' means the plant Cannabis sativa L. and any part of that plant, including the non-sterilized seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with the federally defined THC level for hemp. There is even better news for South Carolina that recently took place, looking at the bigger picture of the Cannabis industry. Delta-8 is legal in South Carolina, thanks to the aligning of South Carolina's state laws under the South Carolina House Bill 3449 and the bill that we all love, The Farm Bill of 2018. So yes, Delta-8, Delta-10, and all other hemp-derived cannabinoids are legal. And you can even order your products online there and travel with them.
There is even better news for South Carolina that recently took place, looking at the bigger picture of the Cannabis industry. Republican Rep. Nancy Mace presented a bill to decriminalize marijuana at a federal level with only 4%, taking the stance that higher taxes "stoke black market sales." Like Delta-8 THC, Mace is aiming to get more support from the GOP. Delta-8 existence is because marijuana is illegal. It's a demystifying process; now even those who've sworn off the idea of THC are trying delta-8.
I've had people tell me that it is "beautiful." I am confident it is. But then they say I should visit these "beautiful houses" in sleek pastel colors with massive verandas that encompass acres of farmland that are home to an endless amount of blooming Magnolia trees. Yeah, I've read Kate Chopin's "Désirée's Baby," I am good. But I will take their words for it! I wholly embrace everyone to love where their from in this world! Hopefully, the next update in South Carolina will be that marijuana is federally legal.
