Purchase CBD in New Jersey
You can still buy CBD in New Jersey, but not the way most people did last year. Signed on January 12, 2026, S4509 (P.L.2025, c.215) is the controlling law. It made it unlawful to sell any hemp-derived cannabinoid product through online retail sales. That provision took effect immediately, on January 13, 2026, and it covers compliant non-intoxicating CBD, not just intoxicating products.
The law also banned sales to anyone under 21 and updated the state hemp definition to use total THC, covering all isomers and analogs, including THCA post-decarboxylation.
CBD oils, topicals, capsules, and isolates are still available from licensed in-store retailers, and every ATLRx product carries a current, lot-specific Certificate of Analysis so you always know exactly what you’re getting.
What Changed April 13, 2026
April 13, 2026, was set as the compliance deadline for the rest of the framework.
Hemp flower or products exceeding 0.3% total THC in the plant, or 0.4 mg of total THC per container, are now legally classified as cannabis in New Jersey. The products can only be sold by retailers licensed by the New Jersey Cannabis Regulatory Commission.
Delta-8, Delta-10, THCA, and chemically synthesized cannabinoids moved into that category.
Intoxicating hemp beverages have a narrow carve-out through licensed liquor retailers and licensed cannabis retailers until November 13, 2026.
