Utah’s hemp law is stricter than the federal baseline. Under the 2018 Farm Bill, hemp and hemp-derived products containing no more than 0.3% Delta-9 THC by dry weight are legal federally. However, Utah does not follow the federal “Delta-9 only” approach that some other states take. Under the Utah Controlled Substances Act and the Utah Hemp and Cannabinoid Act (including amendments made by HB 227 in 2023), several hemp-derived intoxicating cannabinoids, such as Delta-8 THC, Delta-10 THC, and other “artificially derived cannabinoids,” are restricted or prohibited outside Utah’s regulated medical cannabis program, regardless of their hemp origin.
