Effective November 12, 2026, finished hemp-derived cannabinoid products will be limited to 0.4 milligrams of total THC per innermost retail container — regardless of serving size or total package volume — and the federal standard shifts from a Delta-9-only measure to a total-THC measure that includes Delta-9 THC, THCA, and any additional cannabinoids the FDA designates as having similar effects. Most hemp-derived THC beverages currently on the market will not meet this new federal standard. Industry advocacy and proposed legislation (including the Cannabinoid Safety and Regulation Act introduced in December 2025, and separate proposals from Senators Klobuchar and Paul to delay implementation to 2028) may modify this timeline, but absent further action, the new rules take effect on that date.

South Dakota state law: HB 1125 prohibits manufacturing, selling, and distributing industrial hemp products containing chemically derived, chemically modified, or chemically converted cannabinoids. The law took effect July 1, 2024, and active enforcement — including product seizures from retailers — began on July 14, 2025, following a joint notice from the South Dakota Department of Health and Department of Public Safety. AG Marty Jackley’s November 2025 official opinion further indicated that hemp-derived Delta-9 THC beverages produced by distilling or converting CBD may not qualify as legal hemp products under state law, and that without laboratory testing, the legality of any particular hemp-derived drink “cannot be answered.”
