  • A June 2025 Mississippi Attorney General opinion has created enforcement uncertainty at the state level. We encourage Mississippi customers and retailers to stay informed.

On November 12, 2025, Congress enacted H.R. 5371. Section 781 of that law rewrites the federal definition of hemp, replacing the 2018 Farm Bill’s 0.3% delta-9 THC dry-weight standard with a 0.3% total-THC standard (including THCA) and adding a 0.4 mg total THC per-container cap on finished consumer products. The new definition takes effect on November 12, 2026. Industry analyses estimate that most currently marketed hemp-derived Delta 9 gummies will not meet the new cap.
