Yes, hemp-derived CBD is legal in Virginia, though the state regulates it more strictly than the federal government. Virginia Senate Bill 903 (effective July 1, 2023) capped hemp products sold at retail at 0.3% total THC, including THCA and other forms of THC and 2 mg of total THC per package, with an exception for products at a CBD-to-THC ratio of at least 25:1. As of August 15, 2026, that ratio exception has been repealed under HB 30, leaving a firm limit of 0.3% total THC and 2 mg of total THC per package. Oversight has also moved from VDACS to the Virginia Cannabis Control Authority. In January 2025, the U.S. Court of Appeals for the Fourth Circuit declined to block Virginia’s total THC law in Northern Virginia Hemp and Agriculture, LLC v. Commonwealth of Virginia.
