Legality of hemp-derived THC beverages varies by state and is changing at the federal level. The 2018 Farm Bill federally legalized hemp containing less than 0.3% Delta-9 THC by dry weight. Michigan, however, regulates intoxicating hemp-derived cannabinoids under its marijuana framework per Public Act 56 of 2021 (House Bill 4517), effective October 11, 2021 — meaning hemp-derived Delta-9, Delta-8, THCA, and similar products must be sold through CRA-licensed dispensaries.
Federal hemp law is also changing. On November 12, 2025, Congress enacted P.L. 119-37, which redefines hemp using a total-THC standard and caps finished hemp-derived products at 0.4 mg of total THC per container. These provisions take effect on November 12, 2026, and will significantly restrict the hemp-derived THC product category nationwide. We encourage customers to consult current state and federal regulations or a qualified attorney before purchasing.
