What Changed in Texas
In 2019, Texas legalized hemp under a definition tied to the 2018 Farm Bill, allowing products with less than 0.3% Delta-9 THC by dry weight. In March 2026, DSHS adopted a new “total THC” testing standard that includes THCa in the calculation (THCa × 0.877 + Delta-9 THC). Because natural THCa flower typically tests well above the resulting threshold, that flower no longer qualifies as compliant hemp under the new Texas standard.
The rules have been challenged in court, and the legal status has shifted more than once during 2026 as different orders took effect and were lifted. The DSHS rules are currently in effect, and a trial on the merits of the legal challenge is scheduled for July 27, 2026. Because the situation can change quickly, we recommend confirming the current rules before purchasing any smokable hemp product intended for Texas.
