Delta 9 in North Dakota: What the Law Allows
North Dakota has one of the strictest hemp frameworks in the country, and we’d rather tell you that up front than take an order we can’t fill. Delta 9 North Dakota shoppers face real limits, and understanding them saves you time.

North Dakota Delta 9
North Dakota uses the (THCA × 0.877) + Delta 9 formula and requires total THC at or below 0.3% by dry weight. Under HB 1045 (2021) and SB 2096 (2023), synthetic, converted, and isomerized cannabinoids — Delta 8, Delta 10, HHC, THC-O, THCP are excluded from the hemp definition entirely.
North Dakota goes further than most states. State guidance limits naturally-occurring Delta 9 to 5 mg total THC per serving with a Total CBD to Total THC ratio greater than 15:1, and treats Delta 9-only edibles as psychotropic products not permitted at retail. Our Delta 9 gummies, caramels, taffy, and syrup are formulated at 10 mg per piece above what North Dakota allows. We do not ship them there.

Delta 9 in North Dakota – Frequently Asked Questions
Only within narrow limits. Hemp-derived Delta 9 must be naturally derived, meet the total-THC formula (THCA × 0.877 + Delta 9, at or below 0.3% by dry weight), stay at or below 5 mg total THC per serving, and maintain a Total CBD to Total THC ratio above 15:1. Our Delta 9 products are 10 mg per piece and do not qualify. We ship CBD to North Dakota instead.
Naturally occurring, low-dose hemp-derived Delta 9 within the state’s formula and serving limits is permitted. Synthetic or converted cannabinoids and marijuana-derived Delta 9 are not. Most Delta 9 products sold nationally, including ours, exceed North Dakota’s per-serving standard.
Hemp-derived CBD gummies, tinctures, topicals, and capsules that meet the 0.3% total-THC standard. Vapes and other inhalants are not permitted in North Dakota.
