Senate Bill 455, signed June 30, 2022, permanently excluded hemp-derived tetrahydrocannabinols from the state Controlled Substances Act. North Carolina uses the federal Delta-9 standard and applies no total-THC test at the state level. There is no state retailer license requirement for hemp products.
In January 2026, the UNC School of Government confirmed that hemp products remain legal under state law. Much of the noise around North Carolina hemp law has come from proposed bills, not enacted ones.
North Carolina CBD
CBD North Carolina rules are among the least restrictive in the Southeast, but that is changing. Hemp-derived CBD with no more than 0.3% Delta-9 THC is legal under Session Law 2022-32. There is no state licensing requirement and no statewide age limit yet. House Bill 328 would change both, and the House is expected to vote as soon as this week, now that lawmakers have returned to Raleigh after their summer recess.
House Bill 328: What Is Pending
That may not hold much longer.
On July 2, 2026, the Senate passed House Bill 328's conference report 37-6. The House chose not to vote before its summer recess and only returned to session this week, giving it its first real opportunity to bring the bill to the floor.
If it passes and the Governor signs, two things happen.
An age restriction takes effect: it becomes unlawful to sell hemp-derived consumable products to anyone under 21, and unlawful for anyone under 21 to possess them. Topicals are excluded. The bill's original July 15, 2026 trigger date has already passed while the House vote was pending, so this rule will take hold on the corrected date set once the bill is enacted.
November 12, 2026: North Carolina switches from a Delta-9 standard to a total THC standard, capping finished products at 0.4 mg THC per container. Products over that line would become Schedule VI controlled substances.
Even without HB 328, the federal change arrives on November 12 anyway. The date is fixed either way, so the smart move is stocking up on full-spectrum favorites now, while they're still fully compliant.
The Governor's Executive Order No. 16 established a 24-member Advisory Council on Cannabis, with its final recommendations due December 31, 2026.
