AB 45 Changed the Law, and AB 8 Changed It Again

Before AB 45, California’s health department took the position that CBD could not be added to food or supplements. AB 45 reversed that and set up a framework under the California Department of Public Health (CDPH) for hemp in consumable products, with testing and labeling requirements attached.

Since then, CDPH emergency regulations established a no-detectable-THC standard, a 21+ age requirement, and a 5-serving-per-package limit for retail hemp consumables. Assembly Bill 8, signed in October 2025 with Phase 1 effective January 1, 2026, went further — it bans smokable hemp, requires 99%+ extract purity, and moves hemp-THC products into the licensed cannabis market.
