New York Delta 9 Rules
Federal law defines hemp as cannabis containing no more than 0.3% Delta 9 THC by dry weight. New York layers additional requirements on top of that for hemp products sold in-state. Under 9 NYCRR § 114.8, orally consumed cannabinoid hemp products sold in New York are limited to 1 milligram of total THC per serving and 10 milligrams per package, and must carry a CBD-to-THC ratio of 15:1 or higher. New York also does not permit cannabinoids created through isomerization or chemical conversion in its hemp program.
