Federal hemp law changed in November 2025, and New Jersey followed in January 2026 with P.L.2025, c.215 (later amended in March 2026). Under the New Jersey law, “hemp” is now defined using total THC — including delta-8, delta-9, and delta-10 — and any hemp-derived product containing 0.4mg or more of total THC per container is classified as cannabis, which may only be sold by state-licensed cannabis retailers. The law also prohibits online retail sales of hemp-derived cannabinoid products and restricts sales of hemp products to adults 21 and older.
