Let’s Talk Delta-8 State Legality: Florida

If you ever had a trip in Florida as an adult, it’s difficult to imagine that anything is illegal. It is illegal, its just people love breaking the law in public in Florida. Good news though, Delta-8 THC is legal in Florida. I mean it’s the least they can do since medical marijuana is legal. Florida is a step ahead of Georgia—the medicinal products that they sell are psychoactive, giving medicinal patients the relief, they need. Florida is a state that followed the same steps as Georgia, using the federal Farm Bill in 2018 to remove hemp derivatives, cannabinoids terpenes flavonoids and all other compounds from it’s comprehensive.

According to Florida’s Department of Agriculture and consumer services:

“At this time any hemp product intended for human or animal ingestion or inhalation which is sold in Florida must comply with all Florida statutes and rules. Any hemp or hemp extract products offered for sale or sold in Florida must comply with all labeling rules and have a certificate of analysis that shows a total THC content of 0.3% or less. Any hemp or hemp extract product that does not comply with all statutes and rules is subject to enforcement and possible destruction by the Florida Department of Agriculture and Consumer Services.”

Quick and snappy, Delta-8 that is derived from hep that is below the 0.3% THC is legal. This means that you can use, possess, sell, and create delta-8 products without having to worry about any persecution. You can fly with it, and order the products online. Right now, though, the Florida market is booming—you probably have a cannabis dispensary one a block or two away. This isn’t a Mad Max world nor the battle going on in the midwestern cannabis industries. Nor is it Texas, where they banned it, didn’t tell anyone then busted down dispensaries only to have it reversed. That’s how this functions now, the law is the law—to everyone’s surprise, it has worked in the favor of the people.

Delta-8 THC has been on every fans eye due to the fact that—legally, the government is welcome to shut it down any times they want. But Florida has seen a clear economic growth from the hemp industry, just a whooping 370 million in economic impact. It’s hard to not see Delta 8.

The FDACS had this to say:

“Since FDACS began accepting applications to grow industrial hemp on April 27, 2020, Florida has approved more than 800 hemp cultivation permits for farmers in 65 of Florida’s 67 counties, with more than 30,000 acres approved for planting. Commissioner Nikki Fried has been a consistent champion of Florida’s emerging $370 million hemp industry.”

What will be interesting is to see the outcome, will alternate cannabinoids find a separate home within the CBD industry? Will they make delta-8 illegal after passing recreational marijuana? Or will they merge and create an even larger mega-industry? It’s exciting. Of course, there are certain steps that you have to take to proceed in selling hemp and hemp-derived products. We won’t get to see that this year because Florida’s Supreme Court tossed the last legislation after hundreds and thousands have signed. You know Florida did? They said “don’t worry, we will be back.” A new appeal is now underway.
